The Possible Disadvantages of a Structured Settlement
Structured settlement does not always work for every one. The scheduled periodic payment of a judgement also has its own disadvantages. Depending on the situation, it may not be applicable at some point in time.
Sometimes a claimant agrees to a structured settlement so as not to prolong the proceedings and to avoid the expensive cost of a legal battle. No matter how much he wants to receive the lump sum of the settlement, it is not possible if you want the case to be resolved as soon as possible. After all, going through the long court proceedings does not necessarily mean a lump sum settlement. Most likely, the claimant will still end up with the structured settlement.
Although the periodic payment has its advantages, it is without its corresponding disadvantage. One of its disadvantages can be by a claimant who ended up with a life long condition. Since structured settlements will end after some time, the victim may end up having nothing to cover his medical expenses, especially if he is no longer able to work.
There will also come a time when it could be very frustrating for the claimant to know that he can’t relieve his financial strains using the money that is owed to him. Since entering into an agreement for a structured settlement is permanent, a claimant will not be able to demand immediate payment should he want to.
If the sum of settlement is too large, the claimant also runs the risk of not having it fulfilled. There’s a possibility that payments may not be carried out in the future by companies that may go out of business. There is also the possibility of the insurance company failing to fulfil the obligation. It is known that some insurance companies sell the annuity to third parties if they end up having too much settlement accounts in their books.
Engaging in a structured settlement takes a lot of decision making. Having a good lawyer will help you evade some of the nuisance associated with this kind of settlement. Be sure to assess your long term need before deciding to sign the papers.
